1. Agreement to Terms

By accessing or using DevvUP ("the Service"), operated by COMPANY_LTD ("the Company", "we", "us"), you agree to be bound by these Terms of Service.

If you do not agree, do not use the Service.

2. Description of Service

DevvUP is an uptime monitoring service that checks the availability and performance of websites, APIs, and servers. The Service includes:

• HTTP, keyword, SSL certificate, and TCP connectivity checks
• Email, webhook, Slack, and Discord alert notifications
• Public status pages
• Response time and uptime metrics

3. Account Registration

You must provide a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

You must notify us immediately of any unauthorized use of your account.

4. Plans and Billing

DevvUP offers a free tier and paid subscription plans. Paid plans are billed monthly or annually through our payment processor, Stripe.

• Free Plan: Limited monitors and check intervals. No credit card required.
• Paid Plans: Recurring charges apply. You may cancel at any time; access continues until the end of the billing period.
• Refunds: We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us within 14 days.

We reserve the right to change pricing with 30 days' notice to active subscribers.

5. Acceptable Use

You agree not to:

• Use the Service to monitor targets you do not own or have permission to monitor
• Attempt to overwhelm or degrade the Service or target infrastructure
• Reverse-engineer, decompile, or attempt to extract source code
• Resell access to the Service without written permission
• Use the Service for any illegal activity

6. Uptime and Availability

We strive for high availability but do not guarantee 100% uptime. The Service is provided "as is" without warranties of any kind.

We are not liable for any damages resulting from missed alerts, false positives, or service interruptions.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, process, and store data as described therein.

8. Intellectual Property

The Service, including its design, code, and branding, is the property of COMPANY_LTD. You retain ownership of your monitoring data.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings. Upon deletion, your data will be permanently removed within 30 days.

10. Limitation of Liability

To the maximum extent permitted by law, COMPANY_LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Disputes shall be resolved in the courts of Dubai.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect.
